Trademark & Patent

I almost skipped protecting my brand name because I assumed IP filing was for companies with legal departments and deep pockets. Under the Trade Marks Rules, 2017, individuals, DPIIT-recognised startups, and MSMEs all qualify for the reduced e-filing fee of ₹4,500 per class, versus ₹9,000 for larger companies — filed through the Office of the Controller General of Patents, Designs and Trade Marks (CGPDTM) at ipindia.gov.in. A registered trademark stays valid for 10 years and is renewable indefinitely. Patents work on a similarly tiered structure: a startup or natural person pays ₹1,600 for the Form 1 application versus ₹8,000 for a large entity, and can request expedited examination for ₹8,000 (versus ₹60,000), cutting the typical 3–5 year grant timeline down to roughly 18–24 months. On top of the reduced statutory fees, the Startups Intellectual Property Protection (SIPP) scheme has the Central Government pay the entire facilitator's professional fee for any number of patent, trademark, or design filings — a founder only ever pays the government's own statutory charge. This piece walks through the actual filing workflow for both trademarks and patents, what each stage costs, and where founders most often lose money through avoidable mistakes like filing in the wrong class.

This is a short preview. The full article is published on IP India (Office of the Controller General of Patents, Designs and Trade Marks).
